Terms of Service
These Terms of Service ("Terms") govern your use of mobile applications developed by Eric Savoie ("we," "our," or "us") and any related services (collectively, the "Services"). By downloading, installing, or using our apps, you agree to be bound by these Terms.
1. Acceptance of Terms
By accessing or using our Services, you agree to comply with and be bound by these Terms. If you do not agree with any part of these Terms, you must not use our Services.
These Terms apply to all users of our applications, including:
- Free users accessing basic features
- Premium subscribers with paid features
- Trial users during promotional periods
- Any person using our apps on any device
2. Description of Services
Our Services include iOS mobile applications designed to enhance productivity, creativity, and user experience. Each app may offer core functionality, premium features through a subscription or one-time purchase, synchronization, widgets, integrations, updates, and other features described in its App Store listing.
We reserve the right to modify, suspend, or discontinue any aspect of our Services at any time with or without notice.
3. User Accounts and Responsibilities
3.1 Account Creation
Some of our apps may require you to create an account or use a third-party sign-in service. You are responsible for providing accurate information, maintaining the security of your credentials, all activities that occur under your account, and notifying us of unauthorized use.
3.2 User Conduct
You agree not to use our Services to violate applicable laws, infringe intellectual-property rights, upload harmful content, attempt to reverse engineer our apps where prohibited, or interfere with the proper functioning of the Services.
4. Subscriptions and Payments
Some features may require a subscription or one-time purchase. Transactions are processed through the Apple App Store using your Apple Account payment method. Prices, billing periods, trial terms, and renewal terms are shown before purchase.
- Auto-Renewal: Subscriptions renew automatically unless cancelled before the current period ends in accordance with Apple’s displayed terms.
- Cancellation: You can manage or cancel subscriptions through your Apple Account settings.
- Refunds: Refund requests are handled by Apple under its applicable refund policy; we do not process App Store refunds directly.
5. Intellectual Property Rights
All content, features, and functionality of our apps are owned by Eric Savoie and are protected by applicable intellectual-property laws. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable licence to install and use our apps for their intended purpose.
You retain ownership of content you create using our apps. Where an app stores or processes that content, you grant us the rights necessary to provide that Service.
6. Privacy and Data Protection
Our data practices are described in the Privacy Policy and, where applicable, an app-specific privacy notice linked from that app’s product or support page.
7. App Store Terms
Our apps are distributed through the Apple App Store, and your use is also subject to Apple’s applicable terms. Apple is not responsible for our apps or claims relating to them except as required by Apple’s terms or applicable law.
8. Disclaimers and Limitations of Liability
Our Services are provided “as is” and “as available.” We do not guarantee that they will be uninterrupted, error-free, or completely secure.
To the maximum extent permitted by law, Eric Savoie shall not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the Services. Our total liability for claims relating to a Service shall not exceed the amount you paid for that Service in the 12 months preceding the claim.
9. Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless Eric Savoie from claims or expenses arising from your misuse of the Services, violation of these Terms, violation of third-party rights, or content you submit through the Services.
10. Termination
You may stop using our Services at any time by deleting the apps and cancelling active subscriptions. We may suspend access if you materially violate these Terms. Provisions that by their nature should survive termination will remain in effect.
11. Governing Law and Disputes
These Terms are governed by applicable law. Nothing in these Terms removes consumer rights that cannot lawfully be excluded or restricts access to remedies available under applicable law.
12. Changes to Terms
We may update these Terms from time to time. We will post the updated Terms here, update the date above, and provide additional notice where required.
13. Severability
If any provision is found invalid or unenforceable, the remaining provisions will continue in effect.
14. Entire Agreement
These Terms, the Privacy Policy, and any applicable app-specific terms constitute the agreement relating to your use of the Services.
